7. Purpose of Data Processing
To proceed with registration, access, and subsequent use of TECKLAS applications—primarily PROBUS—the User voluntarily provides personal data (mainly identification and contact details), which are used to enable the use of the application. TECKLAS does not own any of the data collected for this purpose.
The collection, storage, modification, structuring, and, when applicable, deletion of the data provided by the Users constitute processing operations carried out by the Controller to ensure the proper functioning of the applications, maintain the service relationship with the User, and manage, administer, inform, provide, and improve the services offered.
The personal data provided by the User—especially email addresses—may also be used to send information of interest, provided that the User has given prior express consent to receive such communications electronically via email or through the application itself.
8. Legal Basis
The processing of User data is carried out in accordance with the legal framework previously mentioned. The use of the Application, whose terms and conditions will always be made available to the User in advance, requires express acceptance. The User’s free, specific, informed, and unambiguous consent is obtained through the availability of this Privacy Policy, which must be accepted via a declaration or a clear affirmative action, such as checking an acceptance box.
If the User does not provide TECKLAS with their data, or provides it incorrectly or incompletely, the use of the Application will not be possible.
9. Retention of Personal Data
The personal data provided by the User will be stored in the systems and databases of the Controller as long as the User continues to use the Application, and unless they request its suspension. Where applicable, and in order to resolve any potential liabilities arising from data processing, the data will be retained for a minimum period of five years.
10. Recipients
Data will not be shared with any third party outside TECKLAS, except in cases of legal obligation or with the prior consent of the User. The data are used solely for purposes related to the use of the Application and its services.
11. Data Retention
TECKLAS informs the User that, as a service provider, it retains for a maximum period of 12 months the essential information necessary to identify the origin of the stored data and the moment the service provision began through the Application.
This data retention does not affect the confidentiality of communications and may only be used within the framework of a criminal investigation or for safeguarding public security and will be made available to competent authorities that so request it with proper legal authorization.
Any information shared with third parties will always be done in accordance with data protection laws and with the utmost respect for such regulations.
12. Protection of Stored Information
The Data Controller adopts the necessary measures to guarantee the security, integrity, and confidentiality of the data in accordance with applicable laws intended to ensure comprehensive protection of personal data and prevent unauthorized use or access.
Although the Controller performs regular backups of content hosted on its servers, it is not responsible for the loss or accidental deletion of data by Users. Likewise, it does not guarantee the full recovery of deleted data, as such data may have been modified or permanently erased since the last backup.
The services provided through the Application—except specific backup services—do not include the recovery of content from backups when the data loss is attributable to the User. In such cases, a recovery fee may be established according to the complexity and volume of the data, subject to the User’s prior acceptance. Data recovery is only included when the loss is attributable to the Controller.
13. Information Security
TECKLAS is committed to managing user information according to the highest information security standards. We maintain a set of physical, electronic, and procedural safeguards that comply with non-public personal information protection standards. These security systems are regularly tested, and we engage third-party firms to audit these systems and processes.
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your electronic device. Account security within the Application is your responsibility. Your password must not be shared with anyone. You accept responsibility for all activities carried out under your user account and credentials.
No representative of TECKLAS will ever ask for your password. Any emails or communications requesting it should be treated as unauthorized and suspicious. If you share your password with third parties for any reason—including the promise of additional services such as account aggregation—those parties will have access to your account and personal information, and you may be held responsible for any actions taken with your credentials.
If you believe someone has gained access to your password, you must change it using the options provided within the Application. If you encounter difficulties, please contact us immediately as described below.
14. Access and Modification of Information
You may review and modify your personal information or account settings at any time by logging into your account or user profile.
You may also close your account at any time. If you close your account, we will mark it as closed in our database but retain the information for record-keeping purposes. This is necessary to prevent fraud and ensure that individuals attempting fraudulent activity cannot reopen new accounts. However, if your account is closed, your personal information will not be used for any other purpose, nor sold or shared with third parties, except as necessary to prevent fraud, enforce the law, or comply with a lawful request from a competent authority.
